Recommendation at Extraordinary Meeting 22 June 2004 that:
1) It be noted in accordance with Section 402 of the Local Government Act, 1993, Council prepared a draft Management Plan with respect to:
(i) Council's activities for the next three years
(ii) Council's revenue policy for the 2004/2005 year
The plan was notified to the Public (Section 405 (1)) through newspaper advertisements and was placed on public exhibition at various locations for a minimum period of 28 days (from May 7, 2004 to June 4, 2004) as required by Section 405(2). In addition the Draft Management Plan was forwarded to the South Precinct and ten local organisations, federal and state local members and various local media outlets.
It was advised to the public that submissions may be made in accordance with legislation to the council at any time during the period of the exhibition.
In adopting the final plans, Council at its meeting held on June 22, 2004 gave consideration to the submissions received concerning the Draft Management Plan in accordance to legislation.
2) Council adopted its Management Plan for the 2004/2007 in accordance with Section 406(1) of the Local Government Act, 1993, including the following amendments.
3) a) An ordinary rate comprising a base charge of $486.30 on each separate parcel of land subject to the rate which represents 49.98% of the total amount payable by the levying of the rate and an ad valorem amount of 0.00155680 cents in the dollar on the land value (base date 2003) of all rateable land categorised as Residential be now made for 2004/2005 in accordance with the Local Government Act 1993.
b) This rate will now appear on the Rates and Charges Notice as "Residential"
4) a) An ordinary rate comprising a base charge of $587.60 on each separate parcel of land subject to the rate which represents 35.71% of the total amount payable by the levying of the rate and an ad valorem amount of 0.0015200 cents in the dollar on the land value (base date 2003) of all rateable land categorised as Farmland be now made for 2004/2005 in accordance with the Local Government Act 1993.
b) This rate will now appear on the Rates and Charges Notice as "Farmland"
5) a) An ordinary rate of 0.00155680 cents in the dollar on the land value (base date 2003) of all rateable land (not being categorised as "Residential" or "Farmland" and not including rateable land used or zoned for commercial, professional, industrial or trade purposes) and sub- categorised as Business - "Ordinary" be now made for 2004/2005 in accordance with the Local Government Act, 1993.
b) This rate will appear on the Rates and Charges Notice as "Business - Ordinary"
6) a) An ordinary rate of 0.00495000 cents in the dollar on the land value (base date 2003) of all rateable land in the Kiama Council area. Determined to be a centre of activity which is used or zoned for commercial, professional, industrial or trade purposes and sub- categorised as "Commercial/Industrial" be now made for 2004/2005 with a minimum amount of rate which will apply in respect to each parcel of land being $477.30 in accordance with the Local Government Act, 1993.
b) This rate will appear on the Rate and Charges notice as "Business - Comm-Ind".
7) A rate of interest of 9% accruing daily on rates and charges that remain unpaid after they become due and payable be now made for 2004/2005 in accordance with Section 566 of the Local Government Act, 1993.
8) The Fee Schedule as proposed in Council's Management Plan for 2004/2005 be adopted.
