Hire of Council reserves

Adopted by Council at its meeting of 19 August 2003

The following policy has been prepared for the hire of Council reserves for wedding receptions and private functions.

  • Vehicles must be restricted to defined parking areas and/or access roads.

  • No trees, shrubs or other vegetation shall be removed, lopped or damaged.

  • Due consideration must be given to other users of the reserve.

  • Establishment and final occupation times shall be kept to an absolute minimum as determined by Council.

  • Lighting of fires other than in designated barbeques is prohibited.

  • The hirer accepts full responsibility for, and undertakes to pay the cost of, restoring any damage to the land, fencing and other improvements resulting from the hire.

  • All rubbish must be removed and the area left in a clean and tidy condition; an inspection of the area will be made following the hiring.

  • All Council ordinances must be complied with.

  • When connecting to mains electricity the hirer will comply with all Acts, regulations and procedures to ensure the health and safety of those persons using the reserve.

  • If requested by Council's ordinance officer, the agreement for the hire and receipt for payments made must be produced.

  • The applicant is to produce evidence of public liability insurance indemnifying Council to a minimum value of $10,000,000. Alternatively, Council can arrange this insurance for a fee.

  • Council is to be absolved from any liability in respect to injury or loss suffered by the applicant or other member of the group whilst on the land.

  • This permit does not take effect until all relevant fees have been paid.

  • Requests for a refund of fees due to cancellation should be made in writing.

  • For events where amplified music is used, a Council Officer would be required to be present.

  • Noise is to be controlled by the hirer so as not to create a nuisance to other park users. Therefore the use of public address systems, large sound systems and other activities that generate excessive amounts of noise cannot be used without the permission of Council. In this regard Kiama Council has established a maximum noise level of 15dba above the average ambient noise level at the nearest property boundary.

  • The use of amplified music be limited to a maximum continuous duration of 3 hours.

  • All performances and the use of amplification must be completed by 9.30 pm unless special approval is granted. Such approval would be given by Council and would be dependent on the type of function and the likely disturbance to neighbours.

  • The hirer shall exercise the permit in a proper and orderly manner to the reasonable satisfaction of the Council and shall not do, or permit to be done on the premises, any act or thing which may be unreasonable or become a nuisance, damage, annoyance or disturbance to the Council or to other persons lawfully using the premises or to the owners or occupiers of any neighbouring land.

  • Council may terminate the booking forthwith, at any time, in the event that the hirer fails to comply with any of the terms and conditions of this agreement, by written notice delivered to the premises or sent to the hirer at the address on the permit or as directed by an officer of Council.

  • All residents of properties located in the immediate vicinity of the function be notified prior to the event by the applicant.

  • If considered necessary, a Council officer will be required to attend the function to ensure compliance with all of Councils' conditions. The cost of the officer's salaries are to be met by the applicant.

  • Should a Council key be loaned out, a fee of $50 will apply and be deducted from the bond if not returned by the due date.

  • It is the applicant's responsibility to ensure the security and safety of any items or equipment required for the event.
