Kiama Development Control Plan 2012 (DCP 2012)


With the gazettal of the Standard Instrument (Local Environmental Plans) Order 2006 by the State Government in March 2006 all Councils were required to prepare a standard instrument Local Environmental Plan (LEP) to apply in their respective Local Government Area. The Kiama Local Environmental Plan 2011 has been prepared to protect the environment and control development within the Kiama Municipality.

As part of this process Council was also required to prepare a single Development Control Plan (DCP) to apply to the Kiama Municipality. The principal purpose of DCP is to provide guidance on the following matters to the persons proposing to carry out development:

  1. giving effect to the aims of the Kiama LEP,
  2. facilitating development that is permissible under the Kiama LEP,
  3. achieving the objectives of land zones under the Kiama LEP.

The provisions of a DCP made for that purpose are not statutory requirements. A DCP cannot be inconsistent with the provisions of the Kiama Local Environmental Plan 2011. A DCP cannot prohibit development where it is permitted by the Kiama Local Environmental Plan 2011.

The Kiama Development Control Plan 2012 (DCP 2012) was adopted by Council on 31 July 2012. The DCP 2012 contains general development control as well as site specific area for specific locations throughout the Municipality.
