Kiama Local Environmental Plans (LEP)

rural-sea.pngA Local Environmental Plan (LEP) has been prepared to guide planning decisions for the local government area.   

The LEP applies a 'zone' (Rural, Environmental Protection, Residential, Centre, Business Park, Industrial, Recreation, Infrastructure) to land within the Municipality. 

All zones have a number of objectives that give an indication of the intention for each zone.  Each zone also contains a list of land uses that are either:

1. Permissible without Development Consent

2. Permissible with Development consent, and

3. Prohibited.

Amendments to Kiama Local Environmental Plan 2011

Amendment No 1 to Kiama Local Environmental Plan 2011 was made by the State Government on 15 August 2014.

Kiama Local Environmental Plan 2011 (Amendment No 1) - This Local Environmental Plan rezones land at Wyalla Road Jamberoo for low density residential and environmental purposes (this Local Environmental Plan was signed by Kim Bray, Manager Strategic Planning, Kiama Municipal Council, as delegate of the Minister for Planning).

Kiama Local Environmental Plan 2011 (Amendment No 2) - This Local Environmental Plan corrects a mapping anomaly of Lots 20 DP 1151501 and Lots 21 to 24 DP 1155392 and applies an R2 Low Density Residential zoning and associated planning controls to the whole of the subject site (this Local Environmental Plan was signed by Kim Bray, Manager Strategic Planning, Kiama Municipal Council, as delegate of the Minister for Planning).

Kiama Local Environmental Plan 2011 (Amendment No 3) - This Local Environmental Plan rezones land at (a) Lots 201 and 202, DP 1199549, Jamberoo Road, (b) Lot 1, DP 1203690, Lilly Pilly Way Kiama to R2 Low Density Residential zoning and applies associated planning controls to the whole of the subject site (this Local Environmental Plan was signed by Philip Costello, Director Environmental Services, Kiama Municipal Council, as delegate of the Minister for Planning). Kiama Local Environmental Plan 2011 (Amendment No 3) was made by the State Government on 13 February 2015.

Kiama Local Environmental Plan 2011 (Amendment No 4) - This Local Environmental Plan removes recreational facility (indoor) as a prohibited activity in the B7 Business Park zone land use table and inserts recreational facility (indoor) business identification signs as permitted with consent in the B7 Business Park zone land use table (this Local Environmental Plan was signed by Philip Costello, Director Environmental Services, Kiama Municipal Council, as delegate of the Minister for Planning). Kiama Local Environmental Plan 2011 (Amendment No 4) was made by the State Government on 25 September 2015.

Kiama Local Environmental Plan 2011 (Amendment No 5) - This Local Environmental Plan applies to part of Lot 1 DP710456, 39 Macquarie Street, Jamberoo and introduced the following controls over the subject land:

Land Zoning - LZN: R2 Low Density Residential
Lot Size - LSZ: 800m2
Height of Buildings - HOB: 8.5m
Floor Space Ratio - FSR: 0.45:1

This Local Environmental Plan was signed by Philip Costello, Director of Environmental Services, Kiama Municipal Council, as delegate of the Minister for Planning). Kiama Local Environmental Plan 2011 (Amendment No 5) was made by the State Government on 27 May 2016.

 

Kiama Local Environmental Plan 1996 has been repealed for the whole of the Municipality EXCEPT for the land identified as "Deferred Matter" under Clause 1.3(1A) of Kiama LEP 2011
