Kiama Local Environmental Plans (LEP)

Each local government area has a LEP to guide development and protect natural resources such as waterways and heritage within local government areas. LEPs are prepared by councils, in consultation with their community and approved by the Minister for Planning (or their delegate).

With the gazettal of the Standard Instrument (Local Environmental Plans) Order 2006 by the State Government in March 2006 all Councils were required to prepare a standard instrument Local Environmental Plans (LEP) to apply in their respective Local Government Area.

The Kiama Local Environmental Plan 2011 has been prepared to guide planning decisions for the local government area.  The LEP applies a standardised 'zone' (Rural, Environmental Protection, Residential, Centre, Business Park, Industrial, Recreation, Infrastructure) to land within the Municipality. All zones have a number of objectives that give an indication of the intention for each zone.  Each zone also contains a list of land uses that are either:

1. Permissible without Development Consent

2. Permissible with Development consent, and

3. Prohibited.

To find the zoning of a property, open the Kiama Local Environmental Plan 2011 mapping guide and find the map number for your area. Once the map number has been determined, proceed to Kiama Local Environmental Plan 2011 maps and scroll to locate the map you are looking for.

In the case of any inconsistencies the Kiama Local Environmental Plan 2011 is overridden by the State Environmental Planning Policies (SEPPs).

Amendments to Kiama Local Environmental Plan 2011

Amendment No 1 to Kiama Local Environmental Plan 2011 was made by the State Government on 15 August 2014.

Kiama Local Environmental Plan 2011 (Amendment No 1) - This Local Environmental Plan rezones land at Wyalla Road Jamberoo for low density residential and environmental purposes (this Local Environmental Plan was signed by Kim Bray, Manager Strategic Planning, Kiama Municipal Council, as delegate of the Minister for Planning).

Kiama Local Environmental Plan 2011 (Amendment No 2) - This Local Environmental Plan corrects a mapping anomaly of Lots 20 DP 1151501 and Lots 21 to 24 DP 1155392 and applies an R2 Low Density Residential zoning and associated planning controls to the whole of the subject site (this Local Environmental Plan was signed by Kim Bray, Manager Strategic Planning, Kiama Municipal Council, as delegate of the Minister for Planning).

Kiama Local Environmental Plan 2011 (Amendment No 3) - This Local Environmental Plan rezones land at (a) Lots 201 and 202, DP 1199549, Jamberoo Road, (b) Lot 1, DP 1203690, Lilly Pilly Way Kiama to R2 Low Density Residential zoning and applies associated planning controls to the whole of the subject site (this Local Environmental Plan was signed by Philip Costello, Director Environmental Services, Kiama Municipal Council, as delegate of the Minister for Planning). Kiama Local Environmental Plan 2011 (Amendment No 3) was made by the State Government on 13 February 2015.

Kiama Local Environmental Plan 2011 (Amendment No 4) - This Local Environmental Plan removes recreational facility (indoor) as a prohibited activity in the B7 Business Park zone land use table and inserts recreational facility (indoor) business identification signs as permitted with consent in the B7 Business Park zone land use table (this Local Environmental Plan was signed by Philip Costello, Director Environmental Services, Kiama Municipal Council, as delegate of the Minister for Planning). Kiama Local Environmental Plan 2011 (Amendment No 4) was made by the State Government on 25 September 2015.

Kiama Local Environmental Plan 2011 (Amendment No 5) - This Local Environmental Plan applies to part of Lot 1 DP710456, 39 Macquarie Street, Jamberoo and introduced the following controls over the subject land:

Land Zoning - LZN: R2 Low Density Residential
Lot Size - LSZ: 800m2
Height of Buildings - HOB: 8.5m
Floor Space Ratio - FSR: 0.45:1

This Local Environmental Plan was signed by Philip Costello, Director of Environmental Services, Kiama Municipal Council, as delegate of the Minister for Planning). Kiama Local Environmental Plan 2011 (Amendment No 5) was made by the State Government on 27 May 2016.

Kiama Local Environmental Plan 2011 (Amendment No 6) - This Local Environmental Plan rezones land at Part Lot 73 DP 1153471, No 35 Bland Street, Kiama, from SP2 Infrastructure to R2 Residential. This Local Environmental Plan was signed by Mark Lyndon, Manager Strategic Planning, Kiama Municipal Council, as delegate of the Minister for Planning). Kiama Local Environmental Plan 2011 (Amendment No 6) was made by the State Government on 10 March 2017.

Kiama Local Environmental Plan 2011 (Amendment No 7) - This Local Environmental Plan permits a livestock processing industry and a restaurant or café at Lot 103 DP 561082 and Lot 1 DP 1005217, No 96 Rose Valley Road, Rose Valley. This Local Environmental Plan was signed by Philip Costello, Director Environmental Services, Kiama Municipal Council, as delegate of the Minister for Planning. Kiama Local Environmental Plan 2011 (Amendment No 7) was made by the State Government on 5 May 2017.

Kiama Local Environmental Plan 2011 (Amendment No 8) - This Local Environmental Plan allows subdivision of allotments with multiple zones and minimum lots sizes and to enable residential development on 26 Drualla Road (Lot 100 DP 1157883) and 2A Downs Place (Lot 101 DP 1157883), Jamberoo. This Local Environmental Plan was signed by Philip Costello, Director Environmental Services, Kiama Municipal Council, as delegate of the Minister for Planning. Kiama Local Environmental Plan 2011 (Amendment No 8) was made by the State Government on 11 August 2017.

 

Kiama Local Environmental Plan 1996 has been repealed for the whole of the Municipality EXCEPT for the land identified as "Deferred Matter" under Clause 1.3(1A) of Kiama LEP 2011
