A dividing fence separates neighbouring properties. 

Dividing fences do not include retaining walls, unless the wall is needed to support and maintain the fence.

Talk to your neighbour and agree on the type, cost and how much you will each pay towards a dividing fence before you start any building or repairs. 

Before building a fence

  1. Check if your property is urban exempt or complying or rural exempt or complying.
  2. Read the Dividing Fences Act 1991 for more information.
  3. Check conditions in Council's Development Control Plan 2012 (Chapter 2, Section 36).

If you can't meet these steps, you'll need to prepare and lodge a Development Application.

Council has no jurisdiction over dividing fence disputes, and in such cases you can contact the Community Justice Centre.
