Council has adopted a Local Preference Purchasing Policy to provide a framework to encourage and support local suppliers and economic activity within the Municipality. Council's aim is to use local suppliers where efficient to do so, to maximise community benefit for the Municipality.

Government Contracts

Prior to entering into a Contract with Council you should read Council's Statement of Business Ethics to ensure you are aware of the standards Council requires.

Register of Council's Contracts

Council is required to publish a register of its contracts with private sector bodies valued at more than $150,000. The Kiama Municipal Contract Register can be viewed online.

Information contained in the Register includes the:

  • contractors name and any related company involved in the contract
  • start date and duration of the contract
  • goods and services to be provided under the contract
  • amount payable to the contractor, any renegotiation provisions, tender methods if applicable, and any payment provisions for operational or maintenance services under the contract.

Making Private Sector Contract information publicly available

Council is bound by the Government Information (Public Access) Act which requires Council to make a range of information publicly available. When Council enters into a private sector contract to provide services to the public on its behalf, Council must have immediate access to certain information in the contractor's records.

Under the Act, Council must be able to access information that:

  • relates directly to the performance of services by the contractor
  • is collected by the contractor from members of the public who are provided or offered the services and
  • is received by the contractor from Council to enable it to provide the services.

Contractors are not required to provide Council with access to:

  • information that would reveal the contractor's financing arrangements, financial modelling, cost structure or profit margins
  • any information the contractor is prohibited from disclosing to Council under any Australian law, and
  • information that if revealed to Council, could place the contractor at a substantial commercial disadvantage, in present or future dealings, with Council.
